Definition

1.2 Buyer: The term “Buyer” refers to the individual purchasing the goods, as defined in this contract, for purposes not related to their commercial or professional activities.

1.3 Sales Contract: The sales contract is concluded between the Supplier and the Buyer via a telematic tool.

Declaration

The Buyer expressly declares to make the purchase for purposes unrelated to their commercial or professional activities.

 

Object of the Contract

With this contract, the Supplier sells, and the Buyer purchases, movable goods indicated and sold on the SAAD Japan website and its electronic catalog.

Pre-Contractual Information

Before concluding the purchase, the Buyer will review the characteristics of the goods shown on the site. Prior to confirming the order with a “payment obligation,” the Buyer is informed about:

  • Total price of the goods, including taxes, shipping, and any other costs.
  • Payment methods.
  • Delivery timeline.
  • Conditions and procedures for exercising the right of withdrawal.
  • Costs associated with returning goods if the right of withdrawal is exercised.
  • Legal guarantee of conformity for purchased goods.
  • Post-sales support and commercial guarantees provided by the Supplier.
  • Supplier’s contact details for information and complaints.

Forms and Terms of Contract Stipulation

The contract between the Supplier and the Buyer is finalized exclusively via the Internet at SAAD Japan’s website. By following the provided procedures, the Buyer formalizes the purchase proposal for the goods displayed.

Conclusion and Effectiveness of the Contract

The sales contract is concluded when the Supplier sends a confirmation email to the Buyer. This email contains the buyer’s details, order number, price, shipping costs, delivery address, and a link to print the contract conditions.

The Buyer must review and verify the personal data and notify the Supplier of any necessary corrections.

The Supplier commits to accurately describing and presenting the products on the site. Any minor discrepancies between the site’s description and the actual product do not affect the validity of the contract, as the product is handmade so there can be slight difference.

Availability of Products

Product availability refers to the actual stock at the time the Supplier issues the order confirmation. The confirmation is indicative, and simultaneous orders may lead to stock depletion. In such cases, the Supplier will inform the Buyer and adjust the order accordingly. If the Buyer opts to cancel the order, the Supplier will refund the amount within 14 days from the cancellation notice.

Payment Methods

Payments can be made via credit card, bank transfer, PromptPay, or other methods specified by the Supplier. All payment communications will occur over a secure line with encryption.

Delivery Times and Methods

After receiving your order, it will be delivered within 4 to 7 business days for local customer and 7 to 14 days for overseas customers. If there is a delay due to bad weather, delivery company circumstances, or any other reason, we will notify you by email.
 *We do not accept specific time slots.

  • The Supplier will deliver within 7 to 14 days. Please do understand these days doesn’t count any public holidays. Shipping may be subject to delays due to unforeseen circumstances beyond our control.
  • The Buyer must respond promptly to any clarification requests to avoid delays.
  • Delivery times, shipping methods, and costs are highlighted on the SAAD Japan website. Any variations will be communicated immediately.

Prices

  • All product prices on the SAAD Japan website are based on Japanese Yen, inclusive of VAT and other taxes.
  • Shipping costs and ancillary charges are detailed during the purchase process.
  • Prices are valid until the date indicated in the catalog.

Right of Withdrawal

The Buyer has the right to withdraw from the purchase without penalty before shipping has been made by the Supplier. The Buyer must inform the Supplier of the withdrawal intention and request for cancellation.

 

Quality and Warranty

These warranty regulations are designed in accordance with the Consumer Purchase Act and apply to the purchase of all items from www.saadjapan.com. The guarantee is in addition to your rights as a consumer under the law
General Warranty Period
Saad Japan’s offers a general warranty of 3-12* months from the date of purchase for all our jewellery, bracelets, earrings, rings, leather goods and gemstone watches. The specific categories have different time of warranty, specified with the product purchase.
Warranty Coverage
  • Material and manufacturing defects: The warranty covers material and manufacturing defects that occur within the warranty period. This includes errors in material and finishing, welding, stone setting, and the like.

  • Defects covered by the guarantee: 

    • Defects in structure or design that affect the product’s functionality. 

    • Improper functioning of locks, hinges or other accessories. 

    • Loss or loosening of stones as a result of incorrect stone setting.

  • Warranty requirements: To use the warranty, you must contact us within a reasonable time after the fault or defect has been discovered. We reserve the right to assess each individual warranty claim.

 

Warranty Obligations

Repair or replacement: 

In the event of a valid warranty claim, we will either repair the product, or replace it with an equivalent product, at no additional cost to the customer. We reserve the right to repair the product up to three times before considering a refund.

Refund

If repair or replacement is not possible, or if this entails unreasonable costs, you are entitled to a price reduction or a full refund in accordance with current legislation.

Warranty Limitations

Normal wear and tear: 

  • The warranty does not cover wear and tear that occurs as a result of normal use and ageing.

Abuse or negligence: 

  • The warranty does not cover damage caused by abuse, negligence, accidents or lack of maintenance.

Unauthorised alterations: 

  • The warranty does not cover any item that have been altered, repaired or adjusted by anyone other than Tom Wood or our approved third parties, as agreed.

External damage: 

  • The guarantee does not cover damage caused by external factors such as accidents, fire, natural damage or other external influences. Other external influences include examples such as damage to paving caused by negligent behaviour or accidents.

Violation of instructions for use: 

  • The warranty does not cover damage that occurs as a result of violations of instructions for use and recommendations for maintenance, for example attempted cleaning of products with harmful chemicals, or similar.

Specific Wear and Tear:

  • Scratches and contact marks; caveat for loss of stones due to wear; groping for colours, on metals and stones via chemicals; wear and tear on locks, hooks and the like over time; naturally occurring gloss reduction on surfaces.

Buyer’s Obligations

  • The Buyer agrees to pay for the goods as specified in the website
  • The Buyer must print and retain this receipt upon completion of the online purchase.
  • The Buyer acknowledges prior review and acceptance of the delivery time terms.

Billing

The Supplier will issue an invoice for each confirmed and paid order. The invoice is available for printing in the “My Orders” section of the Buyer’s “My Account.”

Responsibility

The Supplier is not liable for delays due to force majeure or unforeseen incidents, including internet malfunctions.

Storage of the Contract

The Supplier stores all order contracts digitally/paper form at its premises, ensuring confidentiality and security.

Dispute Resolution and Jurisdiction

Our dispute resolution and jurisdiction policy ensures that all conflicts will be resolved through arbitration in accordance with local laws. The governing jurisdiction for all legal matters will be the court located in Tokyo, Japan.

Privacy and Data Protection

The Supplier protects customer privacy in accordance with Legislative Decree. Personal data is processed for order management, statutory obligations, and commercial relationship management. The Supplier ensures data confidentiality and security, only disclosing information to authorized parties.

Customizable Products

The Supplier offers customized product sizes and designs, with a production timeline of 20 to 40 working days. A surcharge and advance payment are required. Customized products are not eligible for withdrawal rights.
